How Texas Classifies Marital Assets
Texas is a community-property state. Assets possessed by either spouse at the time of divorce are generally presumed to belong to the marital estate, regardless of whose name appears on an account or title. A court divides that estate in a manner it considers just and right, which doesn’t necessarily mean an equal division.
Separate property generally includes assets owned before marriage and those acquired during marriage by gift, devise, or descent. Devise and descent refer to property received through a will or inheritance. A court can’t divide these assets in divorce, but the spouse claiming them must overcome the community-property presumption with clear and convincing evidence.
This standard requires proof that produces a firm belief or conviction about the asset’s character. Effective planning therefore considers both its legal classification and the documentation available to establish it.
Marital Agreements in the Woodlands
A Texas premarital agreement is a contract made by prospective spouses in contemplation of marriage. It becomes effective when they marry. The agreement must be written and signed by both parties, and it may be enforceable without either person exchanging money or another benefit.
These agreements may define rights in current or future property, establish how assets will be managed, and address their disposition after separation, divorce, or death. They can cover business interests, inheritances, and property owned before marriage, but they can’t adversely affect a child’s right to support.
Spouses who are already married may use a written partition or exchange agreement to convert specified marital assets into individually owned assets. Postnuptial agreements are subject to Texas statutory requirements, including applicable financial disclosures. Whether one fits your circumstances depends on your property, objectives, and the information exchanged between the spouses.
We draft and advise clients on prenuptial and postnuptial agreements. We address Texas Family Code requirements, financial disclosure, and the need for a voluntary, uncoerced agreement. We also explain the proposed terms and property consequences so you can make informed decisions before signing.
Documenting & Tracing Individually Owned Assets
Asset tracing connects property held at divorce to its original source. This process may be necessary when an inheritance was deposited into an account, premarital funds moved between institutions, or proceeds from individually owned real estate funded another purchase.
Commingling occurs when individually owned and marital funds or assets are combined. It doesn’t automatically determine an asset’s character, but it can create difficult proof questions when transactions and transfers aren’t clearly documented. Complete records become increasingly important as the financial history grows longer.
Records that may support a separate-property claim include:
- Account statements showing premarital balances and later transfers.
- Gift letters identifying the donor, recipient, and nature of the transfer.
- Wills, probate records, or distribution documents establishing an inheritance.
- Deeds, closing documents, and transaction records connecting one asset to another.
We organize the available evidence, trace assets through relevant transactions, and identify gaps that may affect property characterization.
Protecting Property During Divorce
Divorce-related asset protection often involves two distinct questions: characterization and valuation. Characterization determines whether an asset belongs to the marital estate or one spouse. Valuation establishes what it’s worth, and disputes may remain even when its classification is uncontested.
Business interests, investment portfolios, real estate, and retirement accounts may require valuation. Each asset class calls for different financial records and methods. Attorney Pollard works with valuation professionals and forensic accountants when needed to examine the relevant financial information.
Protecting the marital estate may also require action while the case is pending. Depending on the circumstances and the court’s authority, temporary orders can restrict asset transfers during divorce. We identify property concerns and address them through the available family-law process.
What to Expect from Our Representation
We begin by identifying the purpose of the representation, whether you’re considering an agreement, documenting ownership, or preparing for property division. We then review the relevant ownership records, account history, and transaction documents. The scope of this review depends on the assets and issues involved.
For agreements, we address the proposed terms, disclosure obligations, and signing requirements. For tracing, we determine whether the records connect a current asset to its asserted source. During divorce, we evaluate characterization and valuation separately, then coordinate with appropriate financial professionals when necessary.
Family-law matters involving The Woodlands are generally filed through the district clerk and heard in the district courts serving the part of the community where the case belongs. Because jurisdiction can differ within The Woodlands, the correct filing location depends on the addresses and facts involved. We assess that context rather than assuming every local matter proceeds in the same court system.
